TALENT AGREEMENT


WHAT DO I DO IF I AM APPROACHED BY OUR CLIENT FOR FURTHER TEMPORARY OR PERMANENT WORK?

It is our aim to provide our talent with as much work as required, therefore your Consultant needs to know about all opportunities presented to you by our client in order to co-ordinate your other bookings and to maximise your workload. We invest a large amount of resources in recruiting you as a talent and in maintaining a leading position within our market in order to present you with the best opportunities available. In fact, those two things are all we do! If Talent Connect’s client is interested in offering you a permanent position or future temporary work, please refer them to Talent Connect to make the proper arrangements.

Once you have been introduced to a Talent Connect client company by a Talent Connect representative, you cannot accept temporary, part-time, contract or permanent work directly from that company until a period of one year has elapsed since your last assignment or interview with the client company. In the same way, while working with Talent Connect, you cannot distribute résumés or solicit for direct temporary or permanent work while on assignments with the clients to whom you have been introduced. If you are interested in pursuing future work with a Talent Connect client company, please let us know so that we can represent your interests to the client company in an appropriate manner.

PAY RATES

As we recruit the best talent in the market, we aim to pay the best rates to keep you available to our clients. The pay rate agreed with your Consultant when confirming each assignment is based on a variety of factors including, but not limited to, skill set required and length of assignment, and may vary between assignments. Your pay rate on each assignment is confidential information. It is not appropriate to discuss pay rates, project quotes or fees with the client, client employees or other Talent Connect talent while on assignment. If you have any questions regarding this matter please contact your Consultant directly.

Most employees are covered by an award or registered agreement, but a few jobs and industries are not.

When an employee is not covered by an award or agreement they are considered to be award and agreement free. Award and agreement free employees may have an employment contract. They are also entitled to at least the:

NATURE OF ASSIGNMENT- CASUAL / TEMPORARY EMPLOYMENT

A person is a casual employee if they accept an offer for a job from an employer knowing that there is no firm advance commitment to ongoing work with an agreed pattern of work.

For example, if an employee is employed as casual, their roster changes each week to suit their employer’s needs, and they can refuse or swap shifts, that could mean they are casual.

Specifically, under the Fair Work Act, a person is a casual employee if:

  • they are offered a job

  • the offer does not include a firm advance commitment that the work will continue indefinitely with an agreed pattern of work

  • they accept the offer knowing that there is no firm advance commitment and become an employee.

 

No firm advance commitment

There are only 4 factors that determine whether an employer’s offer doesn’t include a firm advance commitment. They are:

  • whether the employer can choose to offer the employee hours of work and it’s the employee’s choice to work or not

  • whether the employee will be offered hours of work when the business needs them to work

  • if the employment is described as casual

  • if the employee is paid a casual loading (a higher pay rate for being a casual employee), or a specific pay rate for casual employees.

 

TERMINATION

As a casual / temporary employee your employment can be terminated for any reason with minimal to no notice.

SOFTWARE ISSUES

As a talent on assignment with a client company you are expected to work with the software and systems established on the client site. Here are some guidelines you must adhere to while working on assignment through Talent Connect:

Do not load any software (programs, games, utilities, fonts, etc) on the client’s computers.

Do not make changes to any extensions or settings on the client’s computers (i.e. screen savers, colour, memory allocation, desktop organisation, default fonts,

etc) unless these actions are specifically requested by the client company and are consistent with your job description.

Do not copy any programs or files from a client’s computer to your own disks. Illegal copying of programs is subject to legal action.

 

OCCUPATIONAL HEALTH & SAFETY (OH&S)

​All of our Talent are required to ensure they have access to and understand their Occupational Health & Safety (OHS) responsibilities with respect to Talent Connect and the Client. Management of OHS is the responsibility of everyone — our Talent, Talent Connect and the Client — and all have a collective role to play in achieving a safe and healthy work environment. Everybody associated with Talent Connect will work to ensure that they take reasonable care for their own health and safety, and for the health and safety of anyone else who may be affected by their actions.

Talent responsibilities include:

Participating in Talent Connect safe working procedures

Following safe working procedures at our Client workplaces; Working in a safe manner without risk to yourself and others; and Reporting injuries and hazards to our client and to your relevant Talent Connect Consultant.

 

WORKING WITHIN YOUR DESCRIPTION

Please notify Talent Connect immediately if the client asks you to complete a task that was not in your original job description. When we confirm your booking with a client company, we guarantee every hour of work you complete based on the skills required to complete the brief provided at an expert level. If your on-site tasks move outside this brief, we need to confirm with the client that the additional tasks they are requesting can be completed at the same level of expertise as the original brief.

In keeping with our commitment, your Talent Connect Consultant will contact you on the first day of each new assignment to confirm you are working on the task as described via the verbal briefing provided prior to commencement and that you have been provided with a healthy and safe working environment. Regular checks will be conducted with you and Talent Connect’s client depending on length of assignment.

  • The information provided in this application and on your résumé is accurate and up-to-date and that any materials shown in your portfolio are your work and represent your own projects or collaborative efforts.

  • You have read and agree to adhere to the above stated policies while in Talent Connect employ. Lack of adherence to any of the above may result in immediate release from Talent Connect employment.
